Terms of use.
Last updated: 2026-10-29 18:15:42
These terms govern use of jdcapa.lu and contact forms operated by JD Capa in Luxembourg.
2. Eligibility and Age
You confirm that you have legal capacity to accept these Terms and that you are at least 16 years old (or the higher digital-consent age in your country of residence). If you use the Website on behalf of a company, you confirm that you are authorised to bind that company.
3. Website Services and Information
The Website provides information about JD Capa services, project references, an optional AI assistant, contact and booking flows, and newsletter signup. — Content is general information and does not constitute a binding offer, engineering certification, or professional advice until confirmed in a signed contract. — Quotes, budgets and timelines shared online or by email are indicative unless expressly stated as firm in writing. — The AI assistant may produce approximate answers; always verify critical details with our team. — We may modify, suspend or discontinue Website features without prior notice where reasonably necessary for maintenance, security or operations. There is no public “user account” with a password on this Website. Session or booking links may use secure tokens; keep those links confidential.
4. Intellectual Property
All Website content (texts, images, logos, videos, layouts, code and trademarks), including JD Capa branding, is owned by the Company or its licensors and protected by applicable IP laws. You receive a limited, non-exclusive, revocable licence to access the Website for personal or internal business evaluation of our services. You may not copy, scrape, mine, reverse engineer, frame or commercially exploit Website content without prior written consent.
5. Acceptable Use
You agree not to: — violate applicable laws (including sanctions, anti-fraud and data-protection rules); — upload malware or attempt to disrupt, probe or overload the Website; — harvest personal data of others or misuse the assistant/contact forms; — submit unlawful, defamatory, discriminatory or infringing content; — circumvent security or access non-public areas; — use automated bots at a volume that degrades service (except bona fide search indexing). We may block access or delete submissions that breach these rules.
6. Your Submissions and Uploads
If you send messages, briefs or files (plans, photos, estimates), you confirm that you have the right to share them and that they do not infringe third-party rights or contain unlawful material. You grant us a non-exclusive licence to use those materials solely to assess your project, prepare proposals and perform related services. Optional uploads are not required to contact us; if files are missing, we may note that on-site review will be needed. Do not upload special-category or highly confidential data unless we ask for it under a specific engagement.
7. Disclaimers and Liability
The Website is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from Website use, reliance on online content, or temporary unavailability. Nothing in these Terms excludes liability for intent, gross negligence, death or personal injury caused by negligence, or any liability that cannot be limited under mandatory law. If you are a consumer in the EU/EEA, your mandatory statutory rights remain unaffected.
8. Governing Law and Disputes
This Agreement is governed by the laws of the Grand Duchy of Luxembourg, without prejudice to mandatory consumer protections of your country of residence if you are an EU/EEA consumer. EU consumers may use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Subject to mandatory consumer venue rights, disputes are submitted to the competent courts of the Grand Duchy of Luxembourg.
9. Amendments
We may update these Terms. The version published on this page applies from its effective date (2026-10-29 18:15:42 or later notice). For material changes affecting registered contacts, we will provide reasonable notice by email or Website banner where practicable.
